376 Manning Avenue in the City of Toronto is a 3-storey house-form building with a single basement level.It was constructed prior to the advent of the Ontario Building Code. The building area of 91.46 m2 isdetermined by the gross area of the raised basement, which has the largest area of the four floor levelsmeasured to the exterior surfaces of exterior walls. Until recently the building has been operated as ashared rental house primarily accommodating students. Under an original permit application, 376 ManningAvenue was to be renovated as a single-dwelling unit house. Subsequent zoning approval was eventuallyobtained for conversion of the house to a 4-plex containing four separate dwelling units.Renovation of the building has entailed construction of an addition on the west side of the Third Floor.Although original exterior walls are of solid masonry, the new portions of the north- and south-facing ThirdFloor EBFs were constructed using 2 x 6 wood studs under the original permit application for renovation of376 Manning Avenue as a single-dwelling unit house. While under OBC B 9.10.15.5.(2) wood studs wouldhave been permitted in the north- and south-facing Third Floor ETFs as a single-dwelling unit house, underthe updated permit application subsequent to zoning approval for conversion of the house to a 4-plex, thewood studs have the effect of creating a lack of conformance with the acceptable solution contained inOBC B 9.10.14.5.(1), which requires the EBFs to be of noncombustible construction.The proposed alternative solution is based on demonstrating that the performance level of the portions ofnorth- and south-facing Third Floor EBFs constructed using 2 x 6 wood studs will not be less than whatwould be achieved if those portions of the EBFs conformed to the minimum requirements for 1h fireresistancerated EBFs of noncombustible construction.
